Uncontested Divorce

New York enacted no-fault divorce in 2010 so one spouse no longer needs grounds to qualify for a divorce. So long as one spouse swears that the marriage has been "irretrievably broken" for a period of six months or more and both spouses satisfy no fault requirements, the court will grant a divorce.

Some situations require a contested divorce to protect legal and financial rights. A contested proceeding does not always mean trial; it simply means the spouses have not yet reached agreement on one or more material issues, and the court’s involvement is necessary to move the case forward.

Prenuptial agreements are signed by spouses before marriage. They are particularly useful for protecting family inheritances, safeguarding business interests, defining financial responsibilities, and avoiding potential disputes over property and assets.

Postnuptial agreements are signed after marriage and are useful for addressing changes in financial circumstances, protecting assets acquired during the marriage, providing clarity in the event of marital disputes, and updating previous agreements to reflect current situations.

Marital agreements ensure that personal and family assets are protected by clearly defining what belongs to each spouse, preventing disputes and potential loss of assets. They also specify the responsibility for debts incurred before and during the marriage, ensuring one partner isn't unfairly burdened by the other's financial liabilities.

By having a clear, legally binding agreement in place, couples can avoid misunderstandings and conflicts about finances. This clarity helps maintain a healthy relationship and reduces stress.

Every couple is unique, and marital agreements can be tailored to fit individual needs and circumstances, ensuring that both partners' interests are fairly represented. Knowing that there is a plan in place for unforeseen circumstances provides peace of mind, allowing couples to focus on their relationship without financial worries.
